Terms of service
The rules for using Splivex: what the service is, what is expected of you, and what happens when that is not met.

1. Who you are contracting with
Splivex is operated by Noah Maximilian Janko (“we”). Contact: splivex.support@gmail.com.
The contract comes into existence when you create an account, or when you start the trial mode without one. It costs nothing unless you take out a subscription.
2. What Splivex offers
Splivex connects two people who have taken opposite positions on a question for a video conversation of up to twenty minutes. Afterwards each person is asked once whether their view changed.
What we owe you is the attempt to find a suitable counterpart, not a guarantee of one. Whether somebody with the opposite position is available depends on who else is using Splivex at that moment.
We may change, extend or discontinue features. Paid features are announced before they change, and where a change affects your rights you are asked to agree again rather than told afterwards.
3. Eighteen and over
Splivex is only for people aged 18 or over.
The reason is the service itself: strangers see and hear each other live on camera. Your date of birth is required at registration and confirmed by you.
If we learn that an account belongs to somebody under 18, it is closed.
4. Your account
You give a username, an email address and a date of birth, and they have to be accurate. One account per person; do not let anybody else use yours.
Keep your password to yourself. If you believe somebody else has access, change it and tell us.
5. How to behave
Splivex exists for disagreement. Holding a position somebody finds wrong, uncomfortable or provocative is the point of it, and it is not a reason for anything.
These are:
- hate speech and attacks on people for who they are
- threats, intimidation and harassment
- sexual content, nudity and sexual advances
- depictions of violence
- publishing anybody’s personal details
- recording, photographing or streaming somebody who has not agreed to it
- advertising, spam and automated use
- impersonating somebody else
The line is not the opinion, it is the treatment of the person opposite. You can say almost anything here; you cannot do it to somebody.
6. Reports and what follows
Anybody can report a conversation. A report ends it immediately, sends the reason and a single still frame from that moment to moderation, and lets you block the other person at the same time.
Depending on what happened, the response is one of:
- no action, where the report is unfounded
- a warning
- a temporary suspension
- permanent closure of the account, for serious cases
Every decision is made by a person and carries a reason. If your account is suspended or closed, you can object to splivex.support@gmail.com, and we will look at it again.
7. Your content
What you write and say stays yours. To operate the service we need permission to display it where it belongs — your profile to the person you are matched with, a proposed question to everybody once it is approved, and a statement on a question to everybody who has answered that question.
A statement is published and stays until you remove it. You can delete your own at any time; we can remove one that breaks the house rules, and we will say why.
That permission is limited to running Splivex, is not exclusive, and ends when you delete the content or your account.
We do not record conversations, so there is nothing for us to license there. If you and the other person agree to a recording between yourselves, what happens with it is a matter between the two of you — and their agreement has to come before the recording starts, not after.
8. Ending it
You can delete your account at any time under Settings. That ends the contract and removes your data as described in the privacy notice.
We can end the contract for good reason, in particular a serious or repeated breach of section 5. Where possible you will be warned first.
9. Availability and liability
Splivex is provided as it is. We work to keep it available and cannot promise it always will be — a video conversation depends on your network, your device and services we do not run.
We are liable without limitation for intent and gross negligence, and for injury to life, body or health.
For slight negligence we are liable only where an obligation is breached that the contract depends on — one you must be able to rely on for the service to work at all — and then only for the damage typically foreseeable for a service of this kind. Liability under the Product Liability Act is unaffected.
10. Changes to these terms
If these terms change, you are told before the change takes effect and asked to agree. Until you do, the notice stays visible when you open Splivex.
11. Applicable law and jurisdiction
Austrian law applies, excluding its conflict of laws rules and the UN Convention on Contracts for the International Sale of Goods.
If you are a consumer, this does not deprive you of the protection of the mandatory law of the country you live in, and you can bring proceedings at the court of your place of residence.
Dispute resolution
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
